I was supposed to cover this last night but had to delay until now. So let's dig into the railroading of Daniel Penny and talk about why you never want to end up in front of a jury because you acted in self defense. I want to be clear here, I support Daniel in his actions, as unfortunate as the outcome was, but I am going to play devils advocate and look at all the aspects of successful self defense claim. Innocence, Imminence, Proportionality, Avoidance, and Reasonableness.
