I still hear people saying that Donald Trump is being charged with being in possession of classified documents. I think it’s important to clarify this. He’s not being charged with being in possession, He’s being charged with “concealing” the possession of those documents from the Grand Jury. This is an important distinction, because the government do not want to be in a position where they are arguing the presidents authority to be in possession of, or to classify/declassify documents, because if that argument takes place, all of the charges go away.
And that is President Trumps out. His authority to possess/classify/declassify such documents, which has NEVER been tested in the courts.
I believe all of this goes away in a pre-trial hearing over that specific presidential authority. The government will do everything they can to avoid this issue, which is precisely why none of the 37 counts address it.
